General Terms and Conditions of online shop managed by Turistično društvo Bohinj have been drafted in accordance with the Consumer Protection Act (ZVPot, Official Gazette of the Republic of Slovenia, no. 98/2004-UPB2, 126/2007 and 86/2009), on the basis of recommendations of the Chamber of Commerce of Slovenia and international codes of electronic operations.
General Terms and Conditions refer to the operations of the online shop, buyer's rights and the business relationship between the buyer and the seller or the online shop manager.

The manager of the online shop on the website www.tdbohinj.si is Turistično društvo Bohinj, Ribčev Laz 48, 4265 Bohinjsko jezero.

By using the website you agree to the terms of operations, therefore, we kindly recommend you to read them. Turistično društvo Bohinj reserves the right to modify the General Terms and Conditions of the online shop.

AVAILABILITY OF INFORMATION

The provider of services shall be obliged to guarantee the following information to the buyer:

  • company identity (name and head office of the company, registration number),
  • contact data that enable fast and effective communication with the user (e-mail, telephone),
  • accessibility of products (each product or service available on the website, must be accessible in reasonable time period),
  • product delivery or service execution conditions (method, place and deadline for delivery),
  • payment method,
  • clear, evident and unambiguous prices of products and services including the information about VAT and other costs,
  • time validity of the offer,
  • deadline for withdrawing from the contract and the conditions for withdrawal and what will the buyer cost to return a product or cancel a service,
  • explanation of the complaint procedure, including all data about the contact person for addressing the complaint.

The provider of services, Turistično društvo Bohinjm offers products and food, tourist accommodation services and tourist experiences via the website www.tdbohinj.si. General terms and conditions apply for all services and products and are binding for the consumer or buyer.

CONTRACT – ORDER

  • The purchase contract concluded between the services provider and buyer, shall be deemed concluded when the services provider confirms the order and the buyer receives an e-mail from the services provider confirming the purchase. From that moment, all prices and other conditions shall be fixed and shall apply for all contractual parties (for the services provider and for the buyer).

  • By confirming the purchase the buyer shall receive the general terms and conditions of operations from the services provider. The contract, concluded between the services provider and the buyer shall be archived at the head office of Turistično društvo Bohinj, Ribčev Laz 48, 4265 Bohinjsko jezero or on a properly secured remote services provider’s servers. The user can receive a copy of the contract upon request at any time. The request for the contract copy shall be addressed to: [email protected]

The buyer shall receive the copy of the contract upon the submission of the order to their e-mail address.

PRICES

The prices of products and services are in euros / € and are valid on the day of purchase. The prices do not contain delivery fees. When the buyer confirms the purchase in the online shop, all prices at the time of the order shall apply. The online shop prices shall be appropriately marked and apply for all buyers.

We reserve the right to change prices without any preliminary notice. If the price changes due to the error during processing of the online order or if the ordered product is out of stock in that time, the buyer shall receive a written notification via e-mail and shall be offered the possibility to withdraw from the contract or to replace the ordered product or service with another similar product or service offered by the services provider.


SPECIAL OFFERS
General or special offers of products and services and their prices in online shop shall apply until revocation or total sale of stock.
Turistično društvo Bohinj reserves the right to withdraw products and services from the offer without preliminary notice.

SUPPLY, DELIVERY AND TAKEOVER OF GOODS

The goods shall be supplied by the Post of Slovenia or any other distribution company, depending on the agreement or contractual relationship with the company. You can choose delivery method in the purchase process. Delivery shall be made to the address that you as the buyer write at registration or order submission. If you are not home at delivery time, you will receive a note in your postal box to take over the goods at the nearest post office.

Postal fees shall be charged in accordance with the valid price list of the Post of Slovenia, i.e.:
- for internal services (click on the link)
- for international services (click on the link)
The delivery period that enters into force at the submission of the order shall be 5 working days. If the ordered product is out of stock, we will notify you on the possibilities of delivery.

Delivery is only in Slovenia. If you want to make an order for delivery outside Slovenia, please, get in contact with our company via [email protected].

Turistično društvo Bohinj shall be obliged to pack and send the ordered products during delivery time to the buyer’s address.

PERSONAL DATA PROTECTION
Turistično društvo Bohinj shall be obliged to protect data about the buyers and members (personal data, purchase data). Any data sent by the buyer, shall be handled strictly confidential and in accordance with the Personal Data Protection Act (Official Gazette of the Republic of Slovenia, no. 59/1999, 57/2001, 69/2001 - corr.) and Consumer Protection Act (ZVPot-UPB1, official consolidated text, Official Gazette of the Republic of Slovenia, no. 14/03). All data acquired in the online shop of Turistično društvo Bohinj and gathered data shall be used exclusively to execute purchases or for the completion of order. Registration and/or entry of personal data in the online shop shall be required exclusively for proper implementation of online shop services. Data about the buyers shall not be sent to third unauthorised parties.

LIABILITY
Turistično društvo Bohinj shall strive to ensure that all data, published on the website, are updated and accurate. Photos on the website can be of symbolical nature and there can be deviations in colour, quantity, taste, smell or any other feature of the goods of food from those displayed on the photo.

PURCHASE PROCESS

Order, purchase, order confirmation

Our website offers many methods of purchase and reservations of our products and services. You can send an inquiry via our online form to get an offer from us. This shall not be deemed as a confirmed reservation or purchase of products. If your confirmation shall not be received it shall be considered that the reservation is not executed. 
Besides this method we also offer you direct reservation option (by making an advance payment to our bank account on the basis of a proforma invoice). In this case the reservation shall be confirmed and paid immediately when the buyer confirms the payment or when we receive the advance payment on our bank account no. SI56 0700 0000 0013 767, open at Gorenjska banka, Kranj. At any online inquiry it shall be considered that the user or buyer has read and agrees with this General Terms and Conditions.

1. Direct purchase of a product or service
The order shall be made by choosing the product or service and adding it in the cart by clicking “Add to cart”. Then the page showing the content of your cart opens. If you agree with the content of the cart, continue with the purchase by clicking “To payment method”. On this site, enter your data in all boxes, i.e. your name, surname and e-mail address. Confirm that you agree with our Terms and conditions and payment methods, and also with our Privacy Policy.

Under “Payment method” choose your desired payment method, i.e. by proforma invoice (money order to our bank account), moneta or credit card (Mastercard, Diners, Visa or Activa).
Write any comments in the comment field.
At the end please confirm that you agree with the Terms and conditions and payments of our online shop. Confirm the order and submit it by clicking “Finish reservation”. You will receive a thank you e-mail with the order content.

If you choose to pay by proforma invoice (money order to our bank account), you will receive an offer to your e-mail address in 24 hours from the time of purchase with the data for payment of the advance amount. When we receive the advance payment on our bank account, you will receive our confirmation of the reservation or purchase.
If you chose to pay by moneta or credit card, you will receive the confirmation of your reservation or purchase in 24 hours from the time of the reservation of purchase.

2. Demand for product or service

- Private accommodation can be ordered by selecting the accommodation facility and adding it to your cart by clicking “Add to cart”. Then the page showing the content of your cart opens. If you agree with the content, confirm below that you agree with our Terms and conditions and payment methods, and also with our Privacy Policy, and continue your purchase by clicking “Send inquiry”. On this site, enter your data in all boxes, i.e. your name, surname and e-mail address and click on “Send inquiry”. You will receive a thank you e-mail with the order content.

GIFT CERTIFICATES
Turistično društvo Bohinj also enables the purchase of gift certificates. The value of a gift certificate is marked by the buyer. The gift certificate value includes VAT. Gift certificates are transferrable and can be used for services and products offered by Turistično društvo Bohinj.
A gift certificate can be ordered by completing the form with necessary data (name, surname, e-mail, data for payment), under notes write the value of the gift certificate in euros and also write the address to which the gift certificate shall be sent. You will receive data for payment with the proforma invoice (money order to our bank account) in 24 hours from the time of purchase to your e-mail. When we receive the payment on our bank account, we will send the gift certificate by post.

PAYMENT
The payment in the online shop can be made on the basis of a proforma invoice by money order on our banks account no. SI56 0700 0000 0013 767, open at Gorenjska banka Kranj, or by direct payment with a card (Mastercard, Diners, Visa or Activa). We will send the buyer an invoice showing all prices and costs. Single payment is possible.

All issued invoices shall be kept at the company’s head office. Buyers can demand a copy of the invoice via e-mail: [email protected].

RIGHT TO WITHDRAW FROM TOURIST SERVICES PURCHASE, ACCOMMODATION AND EXPERIENCES
Every guest or customer has the right to cancel the reservation in the same way as the reservation was made. If the guest cancels an order that was partially paid for, Turistično društvo Bohinj shall in any case have the right to the reimbursement of administrative costs due to the cancellation of reservation in the amount of 10% for each cancellation.

Besides administrative costs, the agency may also charge the guest or customer the costs for reservation cancellation by withholding the received advance payment. The amount of the reservation cancellation costs depends on the time period before the date of entry into force of the service, in which the customer cancels the reservation and thus makes a preliminary withdrawal from the concluded contract, i.e.
Guests are entitled to the reimbursement of advance payment upon written cancellation of reservation:
- up to 30 days before arrival: 90% of reservation amount
- up to 21 days before arrival: 60 % of reservation amount
- up to 14 days before arrival: 40 % of reservation amount
- up to 8 days before arrival: 20% of reservation amount
- from 7 days to 1 day before arrival the advance payment shall not be reimbursed.

The cancellation of a reservation due to force majeure shall be deemed an exception. The same shall apply if the customer does not arrive and the preliminary reservation was not cancelled in the above mentioned period before the reservation of the arrival or service. In this case, the costs of cancellation in the total amount of the price as determined at the confirmed reservation shall also be charged to the guest.

Guests shall send the information about cancellation or the modification of the reservation in written form by e-mail to the address of the issuer of the reservation confirmation, to [email protected] or by telephone to the issuer of the reservation confirmation, i.e. 00386 (0)4 574 60 10. The provider of accommodation, services and experiences shall encumber the credit card, sent by the guest as the warranty of payment in the amount of the cancellation costs or they shall retain the cancellation costs amount from the paid advance payment.

The amount of the reimbursement of the cancellation costs shall depend on the time of provided cancellation, of the selected reservation type, accommodation and service. Cancellation and costs reimbursement conditions are determined and available for review to the buyer at the site where the buyer is able to see the offer of products or services.

If the reservation is made by credit card, the buyer shall make a reservation by entering the credit card number, its validity and CVV code in the reservation system before the final confirmation. The accommodation services provider cannot view data on the credit card.

If the buyer changes the conditions of the offer or due to force majeure impacting the provision of service, not caused by Turistično društvo Bohinj, the buyer shall not have any right to demand reimbursement of costs or the reduction of price. Any cancellation shall be sent by the guest in written form to Turistično društvo Bohinj, Ribčev Laz 48, 4265 Bohinjsko jezero or via e-mail to [email protected]. THE RIGHT TO WITHDRAW FROM PURCHASE, RETURN OF GOODS ORDERED FROM THE SOUVENIR SHOP
In accordance with the provisions of Article 43 of ZVPot (Official Gazette of the Republic of Slovenia no. 98/2004, 126/2007), the buyer shall have the right to notify the seller in 14 days from the date of the purchase that they withdraw from the contract without reasoning their decision. The right to withdraw from the purchase shall start on the day of the takeover of goods.
The withdrawal from the contract shall be notified by the consumer to the seller’s e-mail [email protected] or to the head office of Turistično društvo Bohinj, Ribčev Laz 48, 4265 Bohinjsko jezero.
The copy of the invoice must be attached to the returned goods.
The only cost burdening the buyer in relation to the withdrawal from contract is the cost of goods return.
If the consumer withdraws from the contract, the product must be sent via post to Turistično društvo Bohinj, Ribčev Laz 48, 4265 Bohinjsko jezero. The services provider shall not be obliged to accept payable parcels or packages that do not apply to the services provider’s General Terms and Conditions.
The buyer shall return the product to the seller undamaged, in original packaging and original quantity, except if the product was destroyed, defect, lost or if its quantity was reduced due to the reasons not caused by the buyer. The buyer may not use the products unlimitedly until the withdrawal from the contract. The buyer can view and test the products in the scope that deems necessary to establish their current state. If the products are used exceedingly, the seller shall have the right to demand the reduction of the product value from the buyer. The consumer shall return the goods by post, whereas the costs of shipment shall be borne by the consumer.
The repayment of the amount shall be made immediately, but in 14 days from the receipt of the notification on the withdrawal from the contract at the latest and when the services provider receives the returned product. Therefore, the services provider shall reserve the right to retain payment in the period from the received notification on the withdrawal until the return of the product.

To ensure certainty, accuracy and timeliness of the return and to keep records on payments, the reimbursement shall be made to the buyer in the same method as the payment was originally conducted (to the bank account of the buyer’s payment card).
The return of the received goods to the company in the period to withdraw from the contract shall be considered as the notification on withdrawal from the contract.

The buyer shall not have the right to withdraw from the contract, when the product shall be customised to the consumer or made according to specific instructions. The buyer shall not have the right to withdraw from the contract if the product itself is not suitable for return (products with short period of use, perishable food products, products with exceeded expiry date) and if the products are newspapers, magazines, periodical publications, gaming products and other cases as stipulated by the Consumer Protection Act.

MATERIAL DEFECT
The buyer can enforce their right due to material defect, if the latter is notified to the seller in two months from the date when the defect was discovered.
The buyer shall describe the defect in detail in the notification and enable the services provider to review the item.
The notification on defect can be given to the services provider in person, whereas the services provider shall issue a confirmation, or send it to the shop where the item was purchased, or to the services provider’s agent with whom the contract was concluded.
The seller shall not be held liable for material defects on goods that shall emerge after two years from the takeover of goods.
It is understood that the defect was present at the takeover, if it is detected within the first six months of takeover. Consumer rights seize to apply after two years from the day when the seller was notified on the material defect.

TECHNICAL MEANS FOR IDENTIFYING AND RECTIFYING DEFECTS BEFORE THE SUBMISSION OF THE ORDER

Before the buyer submits the order, they can review the order to check the data completed for the purpose of order submission.

The buyer can make changes in the cart, i.e. by returning to the previous page.  If the buyer does not want to submit the order, they can leave the page before submitting the order, thus the order is not confirmed.


COMMUNICATION VIA ADS

The services provider shall make contact with the buyer via electronic remote means of communication if the buyer shall not explicitly deny such communication. Ads via e-mail shall contain the following:

- the sender data shall be evident,

- messages will be clearly marked as ads,

- various campaigns, promotions and other marketing techniques will be marked clearly and unambiguously,

- the conditions of participation will be clearly determined,

- the ways to terminate the receipt of ads (user’s wish that they do not want to receive ads will be respected by the services provider and the user will have the right to terminate registration).

CODE OF CONDUCT
The services provider has introduced high internal standards of processing orders, returns and complaints of buyers and shall strive to follow the current demands of consumers and legal regulations. The services provider hereby declares in accordance with item 6 of Article 7 of the Electronic Business Act (ZEPT) that they have not signed the online tradesmen code of conduct.


COMPLAINTS AND DISPUTES

The seller shall respect the current legislation in consumer protection (ZVPot). The seller shall strive to fulfil their duty of introducing an effective complaint management system. The seller shall in five (5) working days confirm to the buyer on receiving the complaint and inform them about the duration of consideration and the process itself.

The contact person with regard to complaints relating to accommodation shall be the head of the tourist information centre and the reception desk, the manager shall be responsible for complaints relating to the souvenir shop. The complaint procedure is confidential.

Turistično društvo Bohinj shall strive to resolve all disputes out of court.
